(male announcer) live from the kron 4 news station, this is the kron 4 news. top stories we are following on this tuesday january 1st. the country has gone over the so-called fiscal cliff. as the midnight deadline for a deal came and went. and now the house is expected to vote on the bill today. plus-- two separate shootings. and at least ten people arrested for public intoxication in san francisco. as the city rang in the new year. a live and taking a live look outside from our roof camera. glancing back at san shots fired in two separate incidents in san francisco as the city celebrated the officers have also arrested at least ten people in the embarcadero area for public intoxication and other misdemeanors. to get you more news faster we turn to kron-four solo police say two people died and three others were injured in a new year's eve shooting. after a fight in a restaurant in the old sacramento area. it happened last night outside the sports corner café. police say some 40-thousand people were gathered in old sacramento for a fireworks show when the gunfire erupted.

officials then canceled the midnight celebration. police are still searching a deadly head on collision shuts down highway 12. police say four people were killed in the accident last night. no word yet on the ages of the victims. again, the accident happened on highway 12 east of rio vista around nine p-m. that section of the highway has reopened this morning. developing news. it went down to the last few hours. and in an early morning session, the senate approved a measure on tax increases and spending cuts. the measure now goes to the house of representatives. ed payne has the story. >> reporter: at the stroke of midnight many people were celebrating. but the mood and washington was much more serious. joe biden went to capitol hill after they struck a deal. and they returned into session, at 2:00 a.m., the vote was cast. >> reporter: 89-8 vote, the spending cuts puts it on the

secretary of state hillary clinton for a blood clot that formed in her head and they're confident she will make a full recovery. they say the blood clot did not cause a stroke, or any brain damage. the clot is located in the vein in the space between the brain and the skull behind the right ear. to help dissolve the clot, they are treating her with blood thinners. she will be released once the medication dose has been established. she was expected to return to the state department this week. the kron four morning news. here's a live look outside. from last night.. 2012 was a record year. for movies. americans went to the theaters in droves this past year. with nearly 11-billion dollars in ticket sales. analysts say that's pretty good. in this age of video streaming on computer tablets and large- screen h-d televisions. one analyst thinks this year may be even better. as a number of high-profile movies are expected to hit the big screen. 2012 was the worst year on record for average gas prices. single day spikes never topped what was seen in 2008, but the nationwide of regular gas hit $3.60 in 2012, according to triple a. that's up 9 cents from last year's record high of $3.51. aaa blamed hurricanes, refinery outages and tensions in the middle east for the high prices. there is some good news. triple a expects gas prices to be lower in 2013, thanks to rising domestic oil production and decreased demand. taking a look at gas prices around the bay area this morning. the average price for a gallon of regular gasoline in san francisco is $3.63

this morning. across the bay in oakland and san jose. the average is $3.54 and $3.55. this compares to the current state average of $3.57. zynga has started shutting down several titles as part of a plan to cut costs at the struggling online game company. games such as petville and mafia wars 2 will no longer be available. the move is part of a broader cost-cutting plan revealed last october, which involved shutting down 13 titles. the company also announced it was cutting 5% of its full-time workforce, a first for zynga. 45 degrees... those looking to clean out their closets in time for the new year got a little bonus. the folks at goodwill held a donate-a-thon at their main location on mission street

in san francisco. those who came to give away their old belongings were assisted by people dressed as bellhops who also gave away popcorn. the first four-hundred people also got free passes to the zoo or movie tickets. event organizers say this is to thank people for their donations, which they call the lifeblood of their charity. >> what these donations do is support ordination and mission. we have freed, a digital class is for people to help them learn how to the mill, and microsoft office. your donation will help them with employment, perhaps even for the very first time. goodwill estimates that close to four-thousand people will donate at their francisco, san mateo and marin counties. that's double their usual number. the bay area is ringing in the new year with a spare the air day. today is the first spare the air alert of the winter season.

map for the north bay ride towards marin county. delay- free. police in oakland are still looking for the gunman who girl. the teenager who died sunday night has been identified as 15-year-old jubrille jordan of oakland. this is what the crime scene looked like sunday night hours after the shooting had happened. keep in mind these gun shots rang out in the afternoon. jordan was killed and a 14 year old boy was shot in the foot. the shooter is still on the lose. oakland police chief howard jordan talked about what he plans to do. to address the rising crime situation in oakland. >> we want more police officers, cops count. perhaps this would have not happened in our city but the bottom line is that this has to stop. the city, the police department have to do a better job of protecting our children. the murder, that

happened on sunday, marked the city's 131st homicide of the year. the chief says that more community involvment is also key to fighting crime in 20- 13. the california supreme court ruled that people who ride on bumper cars and similar attractions at amusement parks can't sue the park operator for injuries they incur in normal use of the rides. the court by a 6-1 vote rejected a claim of negligence in a lawsuit filed against the owners of the great america by a san jose doctor who fractured her wrist during a bumper car ride in 2005. five fresno men were cold but unhurt after their rescue from the big sur wilderness. the men went hiking near china camp friday night but were not prepared for the snow that fell in the higher elevations over the weekend. the men became lost, but were able to get cell service and call for help sunday morning. the hikers were rescued by a c-h-p helicopter. >> it is not just the physical cliff. they're also going to be dealing with the

year from last night. this started practically a immediately. by a writer around 4:00 p.m. and you could have seen it that -- this morning i of our produc by this morning i arrived around 4:00 a.m. and you could not have even have suspected that there was a major celebration. reporting live, jackie kron 4 a deadly shooting brings a violent end to what has been a violent year in terms of homicides in the city of san jose. police were called to the sprawling summer breeze apartments on lewis road where a man was shot and killed in the parking lot. police did not immediately identify the lone, male

victim and would not discuss any possible motive, except to say it is not thought to be gang-related. two people were detained for questioning in the city's 46th homicide in 2012,that would be the most since 1991 when there were 53. the woman accused of crashing into several pedestrians, killing one, near san francisco's twin peaks lookout point last month pleaded not guilty to vehicular manslaughter, d- u-i and hit-and-run charges. police say gina eunice fatally struck a 56-year- old woman on december 20th. at her arraignment, prosecutors say eunice had a blood alcohol content of point-2-3 at the time of the collision. eunice is being held on one million dollars bail. she will be back in court on january 14th. the new year also bringing some new laws. there will be a 10-cent charge for paper bags at grocery stores in alameda county starting today.

gives women greater access to birth control. a-b 23-48 will now allow certified nurses, midwives, nurse practicioners and physician's assistants to prescribe that medication. and, drivers licenses for illegals. some 400-thousand undocumented immigrants will be able to apply for a license. this applies to those in a federal program supporting immigrants who came to states as a child and have not broken the law. the homeowner bill of rights will also go into affect at the start of the year. it's meant to give homeowners more rights to battle forecloser. this set of bills will restrict dual-track foreclosures. when lenders act like they're working with a borrower to modify a loan, while still moving forward with foreclosure. a senate bill also makes it illegal for public and private universities. from forcing students to reveal their usernames or

cleared. and not a lot of police in oakland are still looking for the gunman who shot and killed a teenage girl. the teenager who died sunday night has been identified as 15-year-old jubrille jordan of oakland. this is what the crime scene looked like sunday night hours after the shooting had happened. keep in mind these gun shots rang out in the afternoon. jordan was killed and a 14 year old boy was shot in the foot. the shooter is still on the lose. oakland police chief howard jordan talked about what he plans to do. to address the rising crime situation in oakland. their markups count, we have more officers, to become a more pro-active, to have more cops. and the more proactive in the bottom line is that it has to stop. we, as a community and the police to apartment half to do more to stop the crime on
